I just read your webboard posting, and I am not surprised to here that you lost your license. However, first of all I must ask you one very important question. What is your visual acuity with regular eyeglasses or contact lenses, because if your visual acuity was better than 20/200 you should have been allowed to use the BiOptics to meet the vision requirements? If you visual acuity with regular eyeglasses was better than 20/200, the DMV is outside the bounds of the new law.

However the loss of your driving privileges because you use the BiOptic telescopic lens is not the worst of it, because the vehicle code still allows a person to have just about any other disability imaginable and still drive so long as they can prove that they can compensate for their disability when driving, and many of these drivers have accident rates that up double the accident rate of BiOptic drivers. Now I do have Dennis Keller's e-mail address it is dkelleher@worldnet.att.net however I doubt that he can do much at the moment. Right now, your best bet is to get in touch with your local congressman and get him or her to introduce the following legislation:

Any person who meets the following requirement will be considered qualified to drive under the Americans with Disabilities Act.

Any physical defect of the applicant, which is compensated for to ensure safe driving ability, shall not prevent the issuance of a license to the applicant. There will be no exceptions to this rule, including the visually impaired so long as they the following standard:

1. A visual field of at least 120 degrees.
2. Have the ability to distinguish colors.
3. Be free from other impairments such as reduced cognitive skills.
4. Have a visual acuity of at least 20/40 to 20/70 (with restrictions) through the telescope portion of the lens with a power no greater than 4X or the 5.5X Beecher. There will be no visual acuity cutoffs through the carrier lens.

Any State that refuses to comply with the above regulation shall be subject to the following penalties:

1. The State will not receive any Federal highway money for both the construction of new roads or for maintenance of existing roads.
2. The state will not receive any Federal money for public transportation including money for new transit systems and/or for the day to day operation of existing transit systems.
3. All Federal money for State and Local law enforcement shall be reduced by 25%.

Finally, any public safety or DMV official who does not honestly score the drive test of disabled applicant for the purpose of preventing the issuance of a drivers license to the disabled applicant, shall be subject to the same criminal penalties that an election official would be subject to for denying a person their voting rights based on race, creed, or color.
